1. The Company and Service Description

1. **Service Provision:** Taxi Agafay provides private, licensed, fixed-price transfers to and from the Agafay Desert Camps and Marrakech (including RAK Airport, Medina, and Gueliz).
2. **Licensing:** We operate as a legally registered tourist transport company under Moroccan law.
3. **Route Guarantee:** We guarantee door-to-camp service, utilizing specialized vehicles to navigate the unpaved "piste" roads leading to all major camps.

2. Booking, Quotes, and Confirmation

1. **Booking Inquiry:** All bookings must be submitted via our official channels (Website booking form, WhatsApp, or Email).
2. **Fixed Quotes:** Quotes are based on the vehicle category and journey type (One Way or Round Trip). The quoted price is **fixed** and is not subject to change due to traffic or time of day.
3. **Confirmation:** A booking is only confirmed once you receive a written confirmation email or WhatsApp message from a Taxi Agafay representative detailing the date, time, price, and driver meeting point.
4. **Accuracy:** The Client is solely responsible for providing accurate pickup locations (including specific Riad or Hotel names) and correct flight details (if applicable).

3. Pricing and Payment

1. **Currency:** All pricing is quoted in Euros (€). Payment may be made in Euros or the equivalent in Moroccan Dirhams (MAD) based on the current exchange rate used by The Company.
2. **Payment Method:** Payment for the service is due **in full, in cash,** directly to the driver upon arrival at your destination (or upon completion of the Round Trip service).
3. **Inclusions:** The fixed price includes all local taxes, vehicle costs, driver services, luggage handling, and the navigation of the desert piste road.
4. **Exclusions:** The price excludes voluntary gratuities (tips) to the driver.

4. Cancellation and Amendments

1. **Client Cancellation:**
   • Cancellations made **more than 24 hours** prior to the scheduled pickup time will incur no penalty.
   • Cancellations made **within 24 hours** of the scheduled pickup time may incur a cancellation fee equal to 50% of the quoted One Way price, reflecting the committed driver time and fuel.
2. **Amendments:** Changes to pickup time, date, or location must be requested in writing at least 12 hours in advance and are subject to availability.
3. **Company Cancellation:** In the extremely unlikely event that The Company must cancel a confirmed booking (e.g., due to vehicle breakdown or severe weather making the piste unsafe), a full refund of any pre-paid amount (if applicable) will be issued immediately.

5. Client Responsibilities and Conduct

1. **Punctuality:** For city/riad pickups, the client must be ready at the agreed meeting point at the scheduled time. The driver will wait for a maximum of 15 minutes before the booking is marked as a "No Show," which may result in a 100% charge.
2. **Luggage:** Luggage must be limited to a standard size that can be safely accommodated in the booked vehicle type. Excessive luggage may require the booking of an additional vehicle at the client's expense.
3. **Conduct:** Clients are responsible for their own conduct and that of their party. The driver reserves the right to terminate the journey without refund if the Client is disorderly, abusive, or endangers the vehicle or driver.

6. Liability and Limitations

1. **Delays:** The Company is not liable for delays caused by circumstances beyond its control, including severe weather, unforeseen road closures, government action, or heavy traffic.
2. **Property Loss:** The Company takes reasonable steps to ensure the safety of Client property but accepts no liability for items left in the vehicle after the transfer is complete.
3. **Insurance:** Our vehicles are fully insured for tourist transport under Moroccan law. Liability is limited to the extent of this insurance coverage.

7. Governing Law and Jurisdiction

These Terms and Conditions shall be governed by and construed in accordance with the laws of the Kingdom of Morocco. Any disputes arising from or in connection with these Terms will be subject to the exclusive jurisdiction of the Courts of Marrakech, Morocco.
